FCC Chair Kevin Martin told USA that "whoever wins this spectrum (700 MHz)" will have to provide a "truly open broadband network -- one that will open the door to a lot of innovative services to the consumer."

He said an open network would mean a consumer could "use any wireless device and download any mobile broadband application, with no restrictions," except for illegal or malicious software. USA Today and other news outlets are reporting that Martin has sent or is about to send a draft proposal to his fellow commissioners. A key part of open platforms, Google contends, is that consumers would be able to use any combination of devices, software applications, content, or services. In addition, the company maintains, resellers should be able "to acquire wireless services from a 700-MHz licensee on a wholesale basis," and ISPs should be able to interconnect "at a technically feasible point" to a 700-MHz licensee's wireless network.

Verizon says "No Bueno" to open access according ccording to InternetNews.COM:

WASHINGTON – Verizon Wireless told Congress today consumers would suffer if open access requirements are imposed on the January spectrum auction that is expected to open a new era in wireless broadband services.

The nation's second largest wireless carrier hopes to be a major bidder for the spectrum being vacated by television broadcasters converting to digital signals.

Open access requirements, however, could leave Verizon Wireless, AT&T (Quote), and other incumbent carriers on the sidelines come January since their business models are built on closed networks.

"The one-size-fits-all mentality that characterizes open access regimes for the wireless industry would begin the process of stifling innovation and creativity in our industry," Steven Zipperstein, Verizon Wireless' general counsel, told the House Subcommittee on Telecommunications and the Internet.

ye well, it will not be easy to restrict downloading of illegal or malicious software.... just like it's a big issue on the net with regular pc , but basically he has a point
